Terms & Conditions

1) Eligibility

• You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use MoodPrep.
• By using the Service, you represent that you have the legal capacity to enter into these Terms.

2) Accounts & Access

• To generate or save recipes, you must create an account.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You agree to provide accurate information and keep it up to date.

3) Recipes & Recipe Books

• Public by Default. All recipes generated on MoodPrep are public and permanent. They may be viewed by anyone, whether or not they have an account.
• Recipe Books. Recipe books are public by default and display attribution. You may set recipe books to private if desired.
• Attribution. We provide attribution to recipes and recipe books where appropriate, displaying creator information to give proper credit.

4) Ownership & Licensing

• AI Outputs. Recipes and images are generated using artificial intelligence models.
• MoodPrep Rights. By using the Service, you agree that MoodPrep retains full ownership and rights to all recipes and recipe images generated, including the right to reproduce, distribute, display, publish, or otherwise use them in any medium, format, or product, without compensation or attribution to you.
• Your Input. You retain rights to any original text, notes, or uploads you provide, but grant MoodPrep a worldwide, nonexclusive license to use them for the purpose of operating and improving the Service.

5) AI Disclaimer & Limitations

• AI Generation. Recipes and images are generated using artificial intelligence models.
• Inaccuracies. Outputs may contain errors, unrealistic instructions, unsafe food handling steps, or images that do not reflect actual food.
• No Guarantee. Generated recipes are provided for inspiration and entertainment purposes only and are not a substitute for professional culinary, nutritional, or medical advice.

6) Liability & Assumption of Risk

• Use at Your Own Risk. By using MoodPrep, you acknowledge and agree that any recipe you view, prepare, or consume is at your own risk.
• No Liability. MoodPrep, its affiliates, and employees are not liable for any injury, illness, allergic reaction, foodborne illness, damage, or death that may result from the use, preparation, or consumption of recipes generated or displayed on the Service.
• User Responsibility. You are solely responsible for ensuring safe food handling, preparation, cooking, and storage, as well as determining whether any recipe is safe and suitable for your dietary needs.
• Acknowledgement. By using the Service, you expressly agree to hold MoodPrep harmless from any and all claims, damages, or losses, whether direct or indirect, arising from your reliance on or use of any recipe or feature of the Service.

7) Credits & Plans

MoodPrep uses a credit system:

• Apprentice Chef (default when signing up): 5 free credits.
• Sous Chef: one-time purchase of 60 credits.
• Head Chef: one-time purchase of 200 credits.
• Each recipe generation consumes 1 credit.
• Credits are non-refundable, non-transferable, and expire 12 months after purchase.

8) Payments

• Payments are processed securely via Stripe.
• Credit card information is never stored on MoodPrep servers.
• Purchases are final and non-refundable except as required by law.

9) Account Cancellation & Deletion

• You may delete your account at any time by contacting hello@moodprep.com.
• Data Retention. Recipes and recipe books may remain visible even after your account is deleted, in order to preserve the community and public record of generated content.
• MoodPrep may suspend or terminate accounts that violate these Terms.

10) Intellectual Property

• The MoodPrep name, logo, design, and overall platform are the intellectual property of MoodPrep.
• You may not copy, distribute, or modify the Service without written permission.

11) Prohibited Use

You agree not to:

• Misuse the Service (including attempts to hack, scrape, or overload systems).
• Upload or input harmful, illegal, or abusive content.
• Use the Service for commercial food services or resale without permission.

12) Privacy

• We collect and process data as described in our Privacy Policy (separate document).
• By using MoodPrep, you consent to such collection and processing.

13) Third-Party Links

• Some features (e.g., "Buy Ingredients") may link to third-party sites such as Amazon.
• Purchases made through affiliate links may generate commissions for MoodPrep.
• MoodPrep is not responsible for the availability, pricing, or accuracy of third-party sites.

14) Availability & Changes

• MoodPrep is provided "as is" and "as available."
• We may modify, suspend, or discontinue parts of the Service at any time.

15) Limitation of Liability (Expanded)

To the fullest extent permitted by law:

• MoodPrep disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.
• MoodPrep is not liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to food-related injury, illness, loss of profits, data, goodwill, or other intangible losses.
• If liability is found despite this disclaimer, MoodPrep's total liability shall not exceed the greater of: (a) $25 USD, or (b) the amount you paid to MoodPrep in the past 12 months.

16) Indemnification

You agree to indemnify and hold harmless MoodPrep, its affiliates, officers, and employees from claims, damages, or expenses arising from:

• Your use of the Service,
• Your violation of these Terms, or
• Any harm or injury caused by recipes you prepare or share.

17) Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of laws.
